Issues of ethics are basic to ADR -- of course, there are conduct standards. But ethics also affect acceptable resolutions. Some negotiators happily deceive, people often refuse free money  if they feel the distribution isn’t fair, and almost everyone will cheat – but not too much. Trust increases with a handshake, and while confidentiality is inherent in mediation, even it has limits.
